I assumed\u2014\u201d<\/p>\n<p>\u201cIt\u2019s fine.\u201d<\/p>\n<p>I gave her David\u2019s number.<\/p>\n<p>Then I sat in the dining room and looked at the table where he had first told me our marriage was over.<\/p>\n<p>For the first time, losing it did not hurt.<\/p>\n<p>The courtroom was cool enough that I wished I had brought a jacket.<\/p>\n<p>Jessica sat beside me with two organized stacks of documents. Across the aisle, David whispered to Mark.<\/p>\n<p>He looked good.<\/p>\n<p>That mattered to him.<\/p>\n<p>His suit fit perfectly. His shoes shone. The watch on his wrist cost more than the first car we had bought together.<\/p>\n<p>When he noticed me watching, he smiled.<\/p>\n<p>Not warmly.<\/p>\n<p>It was the smile of a man who believed the scoreboard had already settled the question.<\/p>\n<p>The judge reviewed the agreement.<\/p>\n<p>She asked whether both parties had entered it voluntarily.<\/p>\n<p>\u201cYes, Your Honor,\u201d I said.<\/p>\n<p>David answered the same.<\/p>\n<p>She asked whether we had been represented by counsel.<\/p>\n<p>Yes.<\/p>\n<p>Whether financial disclosures had been exchanged.<\/p>\n<p>Yes.<\/p>\n<p>Whether we understood the settlement.<\/p>\n<p>\u201cYes,\u201d I said.<\/p>\n<p>David barely waited for her to finish.<\/p>\n<p>\u201cYes.\u201d<\/p>\n<p>Jessica\u2019s pen stopped moving.<\/p>\n<p>Mark looked at him.<\/p>\n<p>The judge continued.<\/p>\n<p>She reviewed custody first.<\/p>\n<p>Sam would live primarily with me. David would receive scheduled parenting time. Major decisions concerning education and health would be shared subject to the terms we had negotiated.<\/p>\n<p>David remained expressionless.<\/p>\n<p>Then came the property.<\/p>\n<p>The house to David.<\/p>\n<p>The vehicles to David.<\/p>\n<p>The specified investment properties to David.<\/p>\n<p>The business interests to David.<\/p>\n<p>The accounts identified in the schedules to David.<\/p>\n<p>With every item, his posture relaxed a little more.<\/p>\n<p>Anyone entering the courtroom at that moment would have assumed he was winning.<\/p>\n<p>Maybe he thought the same thing.<\/p>\n<p>Then the judge reached the addendum.<\/p>\n<p>She looked down at the page.<\/p>\n<p>Mark\u2019s head lifted.<\/p>\n<p>The judge said, \u201cThe court also notes that the transfers described above remain subject to the associated obligations allocated under the settlement schedules.\u201d<\/p>\n<p>David\u2019s smile faded.<\/p>\n<p>He leaned toward Mark.<\/p>\n<p>\u201cWhat did she say?\u201d<\/p>\n<p>Mark whispered something.<\/p>\n<p>David frowned.<\/p>\n<p>The judge continued reading.<\/p>\n<p>I watched his face instead of hers.<\/p>\n<p>He picked up his copy.<\/p>\n<p>Turned one page.<\/p>\n<p>Then another.<\/p>\n<p>His movements became slower.<\/p>\n<p>Mark touched his sleeve.<\/p>\n<p>David pulled away.<\/p>\n<p>\u201cWhat is this?\u201d<\/p>\n<p>His voice carried farther than he intended.<\/p>\n<p>The judge looked up.<\/p>\n<p>\u201cMr. Mercer?\u201d<\/p>\n<p>He ignored her for a moment.<\/p>\n<p>His eyes moved down the addendum.<\/p>\n<p>I could tell when he reached the first schedule of secured obligations because his shoulders stiffened.<\/p>\n<p>Then he reached the guarantees.<\/p>\n<p>His fingers stopped.<\/p>\n<p>\u201cWhat did you do?\u201d<\/p>\n<p>The words were aimed at me.<\/p>\n<p>I did not answer.<\/p>\n<p>\u201cMr. Mercer,\u201d the judge said, \u201caddress the court, not Ms. Mercer.\u201d<\/p>\n<p>David looked at Mark.<\/p>\n<p>\u201cThis isn\u2019t what we agreed to.\u201d<\/p>\n<p>Mark\u2019s expression changed from caution to irritation.<\/p>\n<p>\u201cIt is exactly what you agreed to.\u201d<\/p>\n<p>\u201cNo.\u201d<\/p>\n<p>\u201cYou signed it.\u201d<\/p>\n<p>\u201cI signed for the assets.\u201d<\/p>\n<p>\u201cAnd the obligations assigned with them.\u201d<\/p>\n<p>David turned pages faster now.<\/p>\n<p>\u201cYou told me this was fine.\u201d<\/p>\n<p>\u201cI told you repeatedly to read the settlement.\u201d<\/p>\n<p>\u201cYou\u2019re my lawyer. That\u2019s your job.\u201d<\/p>\n<p>\u201cMy job is to advise you. I advised you.\u201d<\/p>\n<p>The judge\u2019s voice cut through them.<\/p>\n<p>\u201cMr. Mercer, sit down.\u201d<\/p>\n<p>He had risen without seeming to realize it.<\/p>\n<p>Slowly, he lowered himself into the chair.<\/p>\n<p>\u201cThis agreement gives me the house.\u201d<\/p>\n<p>\u201cYes,\u201d the judge said.<\/p>\n<p>\u201cAnd the investment properties.\u201d<\/p>\n<p>\u201cYes.\u201d<\/p>\n<p>\u201cAnd the accounts.\u201d<\/p>\n<p>\u201cAs specified.\u201d<\/p>\n<p>\u201cThen why am I assuming all of this?\u201d<\/p>\n<p>He lifted the pages.<\/p>\n<p>The judge looked at him for a long moment.<\/p>\n<p>\u201cBecause the agreement allocates the liabilities associated with the assets you elected to receive.\u201d<\/p>\n<p>David looked at me.<\/p>\n<p>\u201cYou knew.\u201d<\/p>\n<p>\u201cYes.\u201d<\/p>\n<p>\u201cHow much did you know?\u201d<\/p>\n<p>\u201cEnough to read before I signed.\u201d<\/p>\n<p>His face reddened.<\/p>\n<p>Jessica touched my wrist beneath the table, a quiet warning not to be drawn into an argument.<\/p>\n<p>David turned toward Mark.<\/p>\n<p>\u201cHow much?\u201d<\/p>\n<p>Mark lowered his voice.<\/p>\n<p>\u201cDavid\u2014\u201d<\/p>\n<p>\u201cHow much debt?\u201d<\/p>\n<p>The room seemed suddenly too quiet.<\/p>\n<p>Mark opened his own copy of the disclosure summary.<\/p>\n<p>\u201cThe latest figure attached to the marital assets is approximately six-point-eight million dollars.\u201d<\/p>\n<p>David stared at him.<\/p>\n<p>For a second, nothing moved.<\/p>\n<p>Then he laughed once.<\/p>\n<p>It was an empty sound.<\/p>\n<p>\u201cThat\u2019s impossible.\u201d<\/p>\n<p>\u201cNo.\u201d<\/p>\n<p>\u201cThe properties are worth more than that.\u201d<\/p>\n<p>\u201cSome are.\u201d<\/p>\n<p>\u201cSome?\u201d<\/p>\n<p>\u201cThe valuations are not uniform, and several assets secure obligations elsewhere.\u201d<\/p>\n<p>David flipped pages.<\/p>\n<p>\u201cWhat about Mercer Development?\u201d<\/p>\n<p>Mark did not answer immediately.<\/p>\n<p>David\u2019s voice sharpened.<\/p>\n<p>\u201cWhat about my company?\u201d<\/p>\n<p>\u201cThere are approximately four-point-one million dollars in outstanding company obligations reflected in these disclosures.\u201d<\/p>\n<p>David went pale.<\/p>\n<p>\u201cThat isn\u2019t possible.\u201d<\/p>\n<p>\u201cYou signed the company disclosures.\u201d<\/p>\n<p>\u201cI didn\u2019t read all of them.\u201d<\/p>\n<p>Mark stared at him.<\/p>\n<p>\u201cI know.\u201d<\/p>\n<p>The judge removed her glasses.<\/p>\n<p>\u201cMr. Mercer, were these documents made available to you before execution?\u201d<\/p>\n<p>Mark answered carefully.<\/p>\n<p>\u201cYes, Your Honor.\u201d<\/p>\n<p>\u201cDid you advise your client to review them?\u201d<\/p>\n<p>\u201cYes.\u201d<\/p>\n<p>\u201cDid he have an opportunity to ask questions?\u201d<\/p>\n<p>\u201cRepeatedly.\u201d<\/p>\n<p>David shook his head.<\/p>\n<p>\u201cI didn\u2019t understand what this meant.\u201d<\/p>\n<p>The judge\u2019s expression did not soften.<\/p>\n<p>\u201cLack of attention is not the same as lack of disclosure.\u201d<\/p>\n<p>He turned on me again.<\/p>\n<p>\u201cYou set this up.\u201d<\/p>\n<p>\u201cNo.\u201d<\/p>\n<p>\u201cYou knew I would take everything.\u201d<\/p>\n<p>\u201cI knew you wanted everything.\u201d<\/p>\n<p>\u201cThat\u2019s the same thing.\u201d<\/p>\n<p>\u201cNo, David. It isn\u2019t.\u201d<\/p>\n<p>He stared at me with a kind of disbelief that almost made me pity him.<\/p>\n<p>Almost.<\/p>\n<p>For twelve years, David had believed expertise belonged to whoever spoke most confidently.<\/p>\n<p>He had spoken.<\/p>\n<p>I had listened.<\/p>\n<p>He had dismissed.<\/p>\n<p>I had documented.<\/p>\n<p>He had assumed.<\/p>\n<p>I had checked.<\/p>\n<p>Now every number he had considered too boring to read was sitting in front of him.<\/p>\n<p>The judge continued through the agreement.<\/p>\n<p>Then she reached my separate assets.<\/p>\n<p>She confirmed that the property identified as separate would remain mine.<\/p>\n<p>David looked at Mark.<\/p>\n<p>\u201cWhat separate property?\u201d<\/p>\n<p>Mark closed his eyes briefly.<\/p>\n<p>\u201cDavid.\u201d<\/p>\n<p>\u201cWhat separate property?\u201d<\/p>\n<p>Jessica answered.<\/p>\n<p>\u201cAssets belonging to my client before the marriage and assets legally maintained as her separate property, including her trust.\u201d<\/p>\n<p>His head turned toward me.<\/p>\n<p>\u201cTrust?\u201d<\/p>\n<p>I said nothing.<\/p>\n<p>\u201cYou have a trust?\u201d<\/p>\n<p>Jessica spoke before I could.<\/p>\n<p>\u201cThe trust was disclosed as required. Its protected contents are not being transferred to your client.\u201d<\/p>\n<p>David looked stunned.<\/p>\n<p>\u201cHow much is in it?\u201d<\/p>\n<p>\u201cThat is not relevant to the allocation you requested.\u201d<\/p>\n<p>\u201cIt\u2019s relevant to me.\u201d<\/p>\n<p>The judge intervened.<\/p>\n<p>\u201cNo, Mr. Mercer. Not if the property has been properly established as separate and the disclosures satisfy the applicable requirements.\u201d<\/p>\n<p>He stared at me.<\/p>\n<p>\u201cWhen did you do this?\u201d<\/p>\n<p>I met his eyes.<\/p>\n<p>\u201cYears ago.\u201d<\/p>\n<p>\u201cYou hid money from me.\u201d<\/p>\n<p>\u201cNo.\u201d<\/p>\n<p>\u201cYou never told me.\u201d<\/p>\n<p>\u201cI did. You didn\u2019t care enough to remember.\u201d<\/p>\n<p>That landed.<\/p>\n<p>I could see him searching his memory.<\/p>\n<p>Five years earlier, after my father\u2019s estate had settled, I had told David I was placing the inheritance into a trust.<\/p>\n<p>He had been answering email while I spoke.<\/p>\n<p>His response had been, \u201cWhatever makes you comfortable.\u201d<\/p>\n<p>Apparently it had made me comfortable enough to survive him.<\/p>\n<p>The judge asked whether either side had a valid legal objection to entry of the decree.<\/p>\n<p>Mark whispered urgently to David.<\/p>\n<p>David shook his head.<\/p>\n<p>\u201cThere has to be something we can do.\u201d<\/p>\n<p>\u201cYou signed it.\u201d<\/p>\n<p>\u201cI didn\u2019t understand.\u201d<\/p>\n<p>\u201cI told you to read it.\u201d<\/p>\n<p>\u201cYou should have stopped me.\u201d<\/p>\n<p>Mark\u2019s jaw tightened.<\/p>\n<p>\u201cI am your attorney, not your guardian.\u201d<\/p>\n<p>David recoiled.<\/p>\n<p>For once, someone he paid to stand beside him had refused to protect him from his own arrogance.<\/p>\n<p>The judge waited.<\/p>\n<p>Mark finally stood.<\/p>\n<p>\u201cYour Honor, my client is understandably surprised by the practical impact of certain allocations, but I cannot represent that the disclosures were unavailable to him.\u201d<\/p>\n<p>David stared at him as if betrayed.<\/p>\n<p>Jessica rose.<\/p>\n<p>\u201cMy client relied on the same disclosures. She has complied with the agreement.\u201d<\/p>\n<p>The judge nodded.<\/p>\n<p>\u201cThen I see no basis to refuse entry.\u201d<\/p>\n<p>David\u2019s hand closed around the edge of the table.<\/p>\n<p>The decree was signed.<\/p>\n<p>The sound of the gavel was not dramatic.<\/p>\n<p>A single wooden knock.<\/p>\n<p>That was all.<\/p>\n<p>Twelve years ended with less noise than a cupboard door.<\/p>\n<p>David remained seated.<\/p>\n<p>I stood beside Jessica and gathered my purse.<\/p>\n<p>\u201cClaire.\u201d<\/p>\n<p>I stopped.<\/p>\n<p>Jessica glanced at me but did not interfere.<\/p>\n<p>I turned.<\/p>\n<p>David looked older than he had an hour earlier.<\/p>\n<p>\u201cWhy?\u201d<\/p>\n<p>There were a dozen questions inside that one word.<\/p>\n<p>Why had I agreed?<\/p>\n<p>Why had I not warned him harder?<\/p>\n<p>Why had I not fought for the mansion?<\/p>\n<p>Why had I allowed him to believe he was winning?<\/p>\n<p>\u201cBecause you told me what you wanted.\u201d<\/p>\n<p>\u201cYou knew what would happen.\u201d<\/p>\n<p>\u201cI knew what the documents said.\u201d<\/p>\n<p>\u201cYou planned this.\u201d<\/p>\n<p>\u201cNo.\u201d<\/p>\n<p>\u201cDon\u2019t lie to me.\u201d<\/p>\n<p>I stepped closer to the aisle.<\/p>\n<p>\u201cI didn\u2019t make you demand the company.\u201d<\/p>\n<p>His mouth tightened.<\/p>\n<p>\u201cI didn\u2019t make you demand the properties. I didn\u2019t make you insist the assets were yours. And I certainly didn\u2019t stop your lawyer from telling you to read what you signed.\u201d<\/p>\n<p>\u201cYou knew I wouldn\u2019t.\u201d<\/p>\n<p>That was the first completely truthful thing he had said.<\/p>\n<p>I looked at him.<\/p>\n<p>\u201cYes.\u201d<\/p>\n<p>He flinched.<\/p>\n<p>Not because I had tricked him.<\/p>\n<p>Because he finally understood how thoroughly I knew him.<\/p>\n<p>Outside, the Arizona sunlight struck the courthouse steps so hard I had to narrow my eyes.<\/p>\n<p>Jessica followed me toward the parking lot.<\/p>\n<p>Halfway to her car, she let out a short laugh.<\/p>\n<p>\u201cI still cannot believe he signed every page.\u201d<\/p>\n<p>\u201cI can.\u201d<\/p>\n<p>\u201cYou really knew he wouldn\u2019t read it.\u201d<\/p>\n<p>\u201cI hoped he would.\u201d<\/p>\n<p>She stopped.<\/p>\n<p>\u201cDid you?\u201d<\/p>\n<p>\u201cYes.\u201d<\/p>\n<p>That surprised her.<\/p>\n<p>\u201cIf he had read everything and changed his mind, we would have negotiated.\u201d<\/p>\n<p>\u201cYou were prepared for that?\u201d<\/p>\n<p>\u201cI was prepared to be fair.\u201d<\/p>\n<p>Jessica studied me.<\/p>\n<p>\u201cYou weren\u2019t trying to ruin him.\u201d<\/p>\n<p>\u201cNo.\u201d<\/p>\n<p>I looked back at the courthouse.<\/p>\n<p>\u201cI was trying to stop him from ruining Sam and me.\u201d<\/p>\n<p>She opened her briefcase.<\/p>\n<p>\u201cThen this belongs to you.\u201d<\/p>\n<p>She handed me an envelope from a private bank in New York.<\/p>\n<p>I recognized the name immediately.<\/p>\n<p>My trust administrator.<\/p>\n<p>\u201cWhat happened?\u201d<\/p>\n<p>\u201cNothing bad.\u201d<\/p>\n<p>I opened it.<\/p>\n<p>The dormant account structure had been activated under the terms we had arranged once the divorce became final.<\/p>\n<p>I looked at the balance.<\/p>\n<p>For several seconds, I could not speak.<\/p>\n<p>The money would not buy the life David had just demanded.<\/p>\n<p>It would buy something better.<\/p>\n<p>Time.<\/p>\n<p>Safety.<\/p>\n<p>Choices.<\/p>\n<p>Sam\u2019s future.<\/p>\n<p>Jessica watched my face.<\/p>\n<p>\u201cYou\u2019re free, Claire.\u201d<\/p>\n<p>I folded the statement and returned it to the envelope.<\/p>\n<p>Not yet, I thought.<\/p>\n<p>Freedom was not a bank balance.<\/p>\n<p>Freedom was going home to my son and telling him that whatever happened next, I was staying.<\/p>\n<p>I had taken three steps toward my car when Jessica\u2019s phone rang.<\/p>\n<p>She looked at the screen.<\/p>\n<p>Then at me.<\/p>\n<p>\u201cIt\u2019s Mark.\u201d<\/p>\n<p>\u201cAlready?\u201d<\/p>\n<p>She answered.<\/p>\n<p>I watched her expression change while she listened.<\/p>\n<p>\u201cWhat?\u201d<\/p>\n<p>A pause.<\/p>\n<p>\u201cNo, the decree has been entered.\u201d<\/p>\n<p>Another pause.<\/p>\n<p>Her eyes found mine.<\/p>\n<p>\u201cWhat do you mean David wants to challenge custody?\u201d<\/p>\n<p>The air seemed to leave my lungs.<\/p>\n<p>Jessica turned away, listening.<\/p>\n<p>Then she said, very quietly, \u201cSend me whatever he filed.\u201d<\/p>\n<p>She ended the call.<\/p>\n<p>\u201cWhat happened?\u201d<\/p>\n<p>Her face had lost every trace of amusement.<\/p>\n<p>\u201cDavid has realized he can\u2019t easily undo the property settlement.\u201d<\/p>\n<p>I knew the answer before she said it.<\/p>\n<p>\u201cSo he\u2019s going after Sam.\u201d<\/p>\n<p>Jessica nodded.<\/p>\n<p>And in that moment I understood that losing the money had not ended David\u2019s need to win.<\/p>\n<p>It had only changed what he was willing to use as a weapon.<\/p>\n<hr>\n<h2><strong><a href=\"https:\/\/feeleverystory.online\/?p=13760\">Click here to continue reading: PART 4: David Tried to Turn Our Son Into His Last Bargaining Chip, but His Own Company Records Exposed a More Dangerous Secret<\/a><\/strong><\/h2>\n","protected":false},"excerpt":{"rendered":"<p>By the day of the final hearing, David had already begun speaking as though everything were his.
